1. Agreement to Terms

By accessing or using RestWell (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last updated” date.

2. Description of Service

RestWell is a sleep tracking and wellness application that provides:

• Sleep pattern tracking and analysis
• Personalized sleep insights and recommendations
• Habit tracking and streak monitoring
• Bedtime reminders and notifications
• Sleep quality scoring and trends

The App is designed for informational and wellness purposes only and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You must be at least 13 years old to create an account and use the App. If you are under 18, you must have parental or guardian consent.

4. Subscription and Billing

RestWell offers subscription-based access to premium features:

• Free Trial: New users receive a 7-day free trial with full access to premium features
• Monthly Plan: $7.99 per month, billed monthly
• Annual Plan: $39.99 per year, billed annually (save 60%)

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage your subscription and turn off auto-renewal in your App Store or Google Play account settings.

Refunds are handled according to the policies of the App Store or Google Play Store through which you made your purchase.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or its servers
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to collect information about other users

6. Intellectual Property

The App, including its content, features, and functionality, is owned by RestWell and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. Health Disclaimer

RestWell is not a medical device and is not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

If you have or suspect you may have a sleep disorder or other health condition, consult your healthcare provider before using the App.

8. Limitation of Liability

To the maximum extent permitted by law, RestWell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

9. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
